Businessman wants the city,
not LCB, to control noise law

Just when it seemed like the state Liquor Control Board was going to put an end to any events involving liquor and any kind of noise -- be it music or motorcycles -- a new amendment to the state LCB code may allow events like the annual Small Ships Revue in Sharon to continue.

George Warren of Best Wings USA and the Three By the River restaurant complex, which sponsors the Small Ships Revue, Thursday asked Sharon council to consider amending the city's noise ordinance.

The LCB regulates noise when it issues a liquor license. A vendor can be cited if any noise, including music or voices, leaves the property.

Warren asked council to appeal to the LCB to take over enforcing the noise ordinance. A new amendment to the LCB code would allow the city to accept responsiblity for noise enforcement, said Sharon lawyer William McConnell Sr.

McConnell said council would have to file an application with the LCB to accept that responsibility, and the LCB would hold a hearing on the application.

Warren said if city officials don't amend the local law, Three By the River will no longer be able to sponsor activities like the Small Ships Revue in July, weekly Bike Nights during the summer or any other event where there is any outside noise.

Three By the River was cited in July for a noise-ordinance violation. If it is cited again, the LCB will revoke its liquor license, Warren said.

Councilman Raymond Fabian said he would support the city taking over responsibility for enforcing the noise ordinance. He said events held in town are important to Sharon.

McConnell said the city could issue permits for outdoor activities on an event-by-event basis. He said the city could charge a fee for each permit issued.

Councilmen Fred Hoffman, Lou Rotunno and George Gulla said they would also support the change.

Hoffman said the city could probably have the ordinance in place by March.
