Convicted molester asks for acquittal or another trial

A Brookfield man convicted of molesting his stepdaughter since she was 12 wants the charges dismissed or a new trial.

Robert Gibson, 62, North Albright McKay Road, was convicted Feb. 19 of five counts of sexual battery and one count of corruption of a minor for assaulting Beth Danyi, 20, Girard, Ohio, who lived with her mother and Gibson for most of her childhood.

According to a motion filed Monday by lawyer Dan Keating of Warren, Ohio, in Trumbull County Common Pleas Court, Gibson wants all charges dismissed, including seven on which the jury deadlocked.

A second motion asks for a new trial.

Gibson, a former maintenance supervisor at Brookfield Local School District, was charged last year by Brookfield police after the then 19-year-old Ms. Danyi claimed he had raped and sexually assaulted her since she was 12.

Following his conviction, Gibson was returned to jail to await his sentencing which will follow a presentencing investigation.

If Judge John M. Stuard dismisses the motions, Gibson faces 5 to 30 years in prison.

Keating was unavailable for comment. Some of Gibson's family said after the trial that the evidence against him was circumstantial.

Gibson is the father of Robert L. Gibson, III, 38, of 467 S. Albright McKay Road, who faces multiple criminal mischief charges and a criminal trespass charge after he allegedly threw and sprayed semen on women between July and November at stores in and around Eastwood Mall.
