Mom gets 2 years' probation
in case involving girls' rapes

A Masury woman originally charged with four counts of child endangerment was sentenced to probation Wednesday in Trumbull County Common Pleas Court.

Three misdemeanor counts of child endangering were dropped last month against Mary Beth Hearn, 24, of 1121 Broadway Ave., in exchange for her guilty plea to one charge.

She was charged in February after a Trumbull County Children's Services investigation alleged her two young daughters were molested by Ms. Hearn's 19-year-old brother.

During Ms. Hearn's sentencing, she told Judge W. Wyatt McKay that she is working to turn her life around, is looking for a job and is planning to go to cosmetology school.

Her attorney, John Large of Warren, said Ms. Hearn has no criminal record and it is her brother, Mark Hearn, who is being held in Trumbull County Jail on $500,000 bond and is accused of raping the two girls, now 4 and 6 years old.

"She's also jumping through the hoops for the Trumbull County Children's Services board," he added.

Large recommended Ms. Hearn get 2 years of probation and Wyatt agreed, suspending a 6- month jail sentence. Wyatt also recommended Ms. Hearn undergo a mental health assessment for possible treatment.

"I'm glad it's probation," Ms. Hearn's mother, Karen Johnson, 43, of Masury said after the sentencing.

Ms. Johnson is also facing four counts of misdemeanor child endangerment. She was charged by Brookfield police who said she "violated her duty of care, protection and support" to the girls while they were in her custody.

In November, Ms. Hearn's two daughters and her 1-year-old son were placed in foster care by Children's Services. The agency alleged the girls -- then ages 3 and 5 -- were raped by their uncle on Sept. 15 and again on Sept. 20.

A pretrial hearing for Ms. Johnson is scheduled for 9 a.m. April 22 before Judge Andrew Logan. Mark Hearn is undergoing tests to determine whether he's competent enough to stand trial.
