Teen testifies about assault
by pair of fellow classmates

A 15-year-old Sharon boy testified Thursday that two fellow Sharon High School students tied him up and indecently assaulted him with a glow stick.

Stephen Zolnier, 18, of 544 Wengler Ave., is charged with involuntary deviate sexual intercourse, unlawful restraint, indecent assault and criminal conspiracy for his alleged role in the assault.

The boy appeared at a preliminary hearing for Zolnier before District Justice James E. McMahon.

He said he was at a home on Spruce Avenue in Sharon on Dec. 29 to watch a Steelers game when he, Zolnier and a 17-year-old boy started wrestling around.

The victim gave the following testimony:

After about 25 minutes of wrestling, Zolnier and the other boy took off their belts, tied his hands and feet and left the room for a few seconds.

When the pair returned, they pulled down his pants and sexually assaulted him with the glow stick. One of the assailants was sitting on his back.

He heard the 17-year-old say they should get a camera, and there was laughter. He never heard Zolnier say anything.

He never yelled for help and actually laughed a little bit during the assault. "I was in shock. I couldn't believe what was going on ... I was scared."

Before the assault he didn't yell for help because, "I thought it was just like a playful thing."

Ronald Amrhein Jr., Zolnier's court-appointed attorney, asked the victim what happened after the assault.

The victim said everyone finished watching the game, and he spent the night at Zolnier's home.

Assistant District Attorney Neil McEwen opposed Amrhein's questioning as to what happened after the assault. McEwen said what happened afterward was irrelevant as to whether there is sufficient evidence to try Zolnier in Mercer County Common Pleas Court. McMahon agreed with McEwen.

The 17-year-old also testified. Like the victim, he said the boys were "horseplaying ... play-fighting n' stuff." He said the victim murmured something that he and Zolnier couldn't hear, and the victim wouldn't repeat it.

The 17-year-old said they asked the victim if he wanted to tell them "the easy way or the hard way," and the victim said the hard way.

The boy said neither he nor the victim knew what "the hard way" meant. He said he thought they were just going to tie the victim up and then let him go.

After the assault, the 17-year-old said he threw the glow stick away.

All of the charges against Zolnier were held to court. He was released on $50,000 bond.

The 17-year-old was petitioned to Mercer County Juvenile Court on the same charges as Zolnier.
