Convict sues for $4 million, nude pictures of his ex-wife

A former Sharon man serving time in state prison is suing Sharon police for $4 million and demanding they return nude photos of his ex-wife.

Jody Gabriele, 41, formerly of 352 Elm Ave., claims the police developed two rolls of film he had in his possession when he was arrested on Oct. 21, 2001.

Gabriele was arrested after he and Edward Boles forced their way into a home at 145 N. Water Ave. and began fighting with Michael D. Harris of Chicago. Harris pulled out a handgun and shot at Gabriele and Boles as they ran away from the home. Boles was found near Bridge Place and North Irvine Avenue with a gunshot wound and died at the hospital of Sharon Regional Health System.

Gabriele pleaded guilty in January to making threats, a misdemeanor, for his part in the incident. Police said the shooting was self-defense and Harris was not charged.

In his lawsuit filed June 6, Gabriele says the film, which contained sexually explicit photos of his then-wife Jamie, had nothing to do with the investigation of Boles' death. The couple has since divorced.

In his lawsuit, Gabriele alleges Sharon police made more than one set of photographs. One set was returned to the former Mrs. Gabriele on Oct. 25, 2001. The other set, the lawsuit claims, is still in the possession of Detective Walter Bedich. Bedich, Gabriele claims, was showing the pictures around the police station "like they were his trophy."
