Trial date set for former cop charged with solicitation

A trial date has been set for a former Brookfield patrolman accused of making sexual advances toward a man he pulled over for a traffic violation.

Timothy H. Gregory II, 29, of Cortland appeared in Trumbull County Eastern District Court Thursday for a pre-trial hearing, but most of the discussion about the case was held privately with the prosecutor and Gregory's attorney.

Judge Ronald J. Rice Friday set Dec. 2 for Gregory's trial.

Gregory was arraigned before Rice on Aug. 26 on charges of solicitation, unlawful restraint and importuning. Importuning is a first-degree misdemeanor; solicitation and unlawful restraint are third-degree misdemeanors. He pleaded not guilty to the charges and was released on his own recognizance.

If Gregory is convicted of all charges, he could face up to 10 months in jail and $2,000 in fines, Brookfield Police Chief Dan Faustino said in August.

Charges stem from a complaint Faustino received on Aug. 9 from a 20-year-old man who said Gregory stopped him at 2:30 a.m. on either July 11 or 18, police said.

According to a report from Trumbull County Sheriff's Office Detective Rick Tackett, the man claimed that after he admitted to drinking two beers, Gregory told him he was taking him to the police station for a breath test.

Instead, according to the report, Gregory took the man to a construction site on Custer Orangeville Road, where Gregory asked the man if he would perform oral sex on him. The man refused that offer and an offer of money, and then Gregory took the man home, the report said.

According to the report, Gregory told the man if he didn't tell anyone, he would never bother him again. The man later reported the alleged incident to his mother and a friend before coming forward.

Faustino began an internal investigation and placed Gregory on paid administrative leave after receiving the complaint. He also reported the incident to the sheriff's office. Gregory resigned Aug. 25.

Gregory joined the force in January 1996 as a reserve officer and was made full-time in May 1998.

Gregory's attorney, George Gessner, of Cortland, was unavailable for comment. Gregory did not return a phone call made to his home Friday.
