Based primarily on two hours of testimony from the 13-year-old victim, District Justice Henry J. Russo, Hermitage, held for court charges against three men who allegedly had sex with her.
The girl, from the West Middlesex area, testified that Michael V. Bailey, 22, of 531 Cedar Ave., Sharon, forced himself on her Oct. 14 at the mobile home of his brother, Marcus A. Bailey, 24, of Lot 193 Oakleaf Estates, Shenango Township.
Later that day, she had sex twice with Christopher J. Benson, 18, of 790 Highland Road, Sharon, and sexual contact with Marcus Bailey, she said.
The girl was staying with a friend and her friend lied to her mother when they asked to go out with the Baileys.
"We told (her friend’s) mom that they were my brothers and that they were going to take us to Eat ‘N Park and were going to have us back in a couple of hours," the 13-year-old testified.
Marcus Bailey, driving his brother’s car, picked them up and took them to his mobile home, she said.
Marcus Bailey and the friend left, leaving Michael Bailey and the girl alone, she said. He told her: "I like you, I have feelings for you, I want to have sex with you and if you tell anybody about it I have enough people to do something about it," she said.
The girl said she kicked and screamed during the incident and told him to stop. He bit her on the stomach, she said.
After the alleged rape, the girl left the mobile home and went to the home of a friend nearby, but didn’t tell anyone about the encounter and returned to Marcus Bailey’s home, she said.
The girl said she acquiesced to Benson and Marcus Bailey when they said they wanted to have sex with her. She said she didn’t want to have sex with them but also didn’t want the men to force themselves on her.
The girl said all three men knew how old she was.
These charges will proceed to Mercer County Common Pleas Court:
The defendants were returned to Mercer County Jail after failing to post a reduced bond of $15,000.
