Sex charges net man 2 years in prison

A Farrell man who pleaded guilty to attempted rape was sentenced Tuesday to 2 years' imprisonment.

After his sentencing by Trumbull County Common Pleas Court Judge Andrew D. Logan, Christopher Kucik, 21, of 924 Norris Ave., was taken to Trumbull County Jail in Warren.

Kucik will soon be transferred to Lorain (Ohio) Correctional Facility, said Assistant Prosecutor Thomas C. Wrenn.

After an adjustment period at Lorain, he will be transferred to another prison to serve the balance of his term, Wrenn said.

Kucik pleaded guilty in April to six counts of attempted rape. He was sentenced to 2 years in prison on each count, but the terms will run concurrently, Wrenn said.

After his release, Kucik will be on 5 years' probation and must register as a sexually oriented offender under Ohio's version of Megan's Law, Wrenn said.

Wrenn said he's not sure how Megan's Law will cross the border should Kucik move back to Pennsylvania. Kucik might still have to register with the Trumbull County Sheriff's Department, Wrenn said.

Lorinda Hinch, first assistant district attorney in Mercer County, said many provisions of Megan's Law have been deemed unconstitutional by state courts, but under the latest version of the statute, Kucik would have to register with state police for 10 years.

The Pennsylvania law applies to people who live, work or are students in Pennsylvania and were convicted in another state of a sex offense equivalent to a crime in Pennsylvania, she said.

Kucik was indicted in October by a Trumbull County grand jury on six counts of rape. The incidents occurred in February and March 2000 in Brookfield and involved a 12-year-old girl, Wrenn said. Kucik did not force the girl to have intercourse, Wrenn said.

At Kucik's sentencing, the girl's mother spoke about the case's effect on the family, Wrenn said.

Kucik was on house arrest at the time of the indictment. He had pleaded guilty to statutory sexual assault for having sex with a 13-year-old girl Dec. 10, 1999, in Farrell.

Kucik had served 3 months in jail before he was placed on house arrest.
