2 of 3 in shooting case headed to court

Mercer County District Attorney's Office withdrew charges against one of the three Warren, Ohio, men allegedly involved in a Feb. 19 drive-by shooting in Farrell.

Assistant District Attorney Robert Kochems said further evidence developed since the arrest of Brian E. Miller, 21, led him to ask District Justice Henry J. Russo, Hermitage, to drop charges of unlawful restraint and tampering with evidence.

Russo granted the request Friday.

Two other men facing more serious charges agreed to let their cases proceed to Mercer County Common Pleas Court.

Donnell T. "Deacon" Stubbs, 20, was charged with two counts of attempted homicide, four counts of aggravated assault, five counts of reckless endangerment and one count of carrying a firearm without a license.

Terrell A. "Styles" Myrick, 21, faces charges of two counts of conspiracy to commit homicide, four counts of conspiracy to commit aggravated assault, five counts of conspiracy to commit reckless endangerment and one count of carrying a firearm without a license.

Stubbs and Myrick stipulated that if they went through with their preliminary hearings Friday, the prosecution would be able to show a crime occurred and that they might have been involved.

They were returned to Mercer County Jail after failing to post $10,000 bond.

Stubbs fired several shots at a car occupied by Dwayne M. Smith, 27, of 906 Hamilton Ave., Farrell, and Lamar Wilder, whose last known address was 1141 Fruit Ave., Farrell, when their cars passed in the 200 block of Roemer Boulevard, Farrell, police said.

Stubbs and Wilder argued over a girl in the 900 block of Negley Street, Farrell, just before the shooting, police said.

Police said shots also could have been fired from the Smith-Wilder vehicle, which Smith was driving.

Myrick drove the car, which also contained an 18-year-old woman and two girls, ages 15 and 17, police said.

Miller had been accused of preventing one of the girls from getting out of the car and helping conceal the gun, police said.
