Board to continue cyber litigation

Slippery Rock School Board is continuing its opposition to cyber charter schools.

Slippery Rock is one of numerous school boards involved in a lawsuit against E-Academy Charter School -- also known as "Einstein Academy" -- in Bucks County for questionable operations.

Now the board is concerned about the Western Pennsylvania Cyber Charter School and the Pennsylvania Virtual Charter School.

School Director Michael Bruno said he spoke to parents who believe their children have done better with their studies after going online with the two cyber schools. "We need to know the difference between these and the Einstein case," Bruno said.

Business Manager Paul Cessar said one of the cyber schools billed both the state and the district for student tuition. "I'd pay the invoice, then the state would still withhold from our subsidy," he said.

Lawyer Tom Breth, standing in for Solicitor Tom King, said the suit involving Western Pennsylvania Cyber and the Pennsylvania Virtual charter schools also has to do with the belief of many school boards and the Pennsylvania School Board Association that cyber charter schools do not fall under Pennsylvania Charter School Law of 1997 because they can't regulate attendance, homework and other activities.

The PSBA sued the state Department of Education last year for withholding subsidies from districts that didn't pay tuition for students to attend cyber charter school.

However, a Butler County judge ruled that until the matter is settled, districts involved in the Einstein litigation are exempt from paying tuition for their students..

Slippery Rock and other school boards hope the same outcome will result in the new litigation, which is being led by Levin Legal Group, the chief counsel for PSBA.

At the request of Bruno and other board members, Breth said he would look into the anticipated costs of the lawsuit.
