Man gets 6 years in prison for assault on stepdaughter

A Brookfield man convicted of sexually assaulting his step-daughter since she was 12 was sentenced Thursday to 6 years in jail by Trumbull County Common Pleas Judge John Stuard. The victim is now 20.

Robert Gibson, 62, of North Albright McKay Road, who was convicted in February on five counts of sexual battery and one count of corruption of a minor, was sentenced to 2 years for the corruption charge, and 4 years for each of the sexual battery charges, which are to be served concurrently.

The jury was deadlocked on seven other charges related to the crime and the judge threw out one charge on a technicality.

According to Gibson's attorney, Dan Keating of Warren, his client was subsequently found not guilty of the seven charges on April 18 by Stuard, after requests by Keating for a new trial or an acquittal on those charges.

"The effect is, it would prevent a retrial," said the attorney, adding that his request for a new trial was denied.

"Based upon the evidence that came out on the case, which was certainly not clearcut, and that the judge found him not guilty of 8 out of 14 charges, it was pretty stiff," Keating said, referring to the sentence.

Gibson faced 5 to 30 years in prison.

Stuard also named Gibson a sexually oriented offender, which means he must register and check in with the local sheriff's department every year for 10 years after his release from the Lorain Correctional Institution, a Trumbull County prosecutor's office official said. If he moves out of state, he must register with that state's sexual-predator program. Pennsylvania is the only state that does not require sexual predators to register.

Keating's request for a stay of sentence for Gibson pending an appeal was denied.

Gibson's son, Robert L. Gibson, III, is serving a 60-day sentence in Trumbull County Jail for throwing semen on female shoppers in Trumbull County.
