Attempted homicide charge is withdrawn

Mercer County District Attorney's Office has withdrawn a charge of attempted homicide against a Warren, Ohio, man in a Nov. 1, 2001, bar shooting, while other serious charges are proceeding to court.

Assistant District Attorney William Moder said Friday he could not show that Solomon "Grungy" Owens, 24, intended to kill Robert T. Mosley, 29, of Sharon, when he fired a .25-caliber pistol.

No words were exchanged between the men, such as a threat by Owens, and the bullet entered Mosley's abdomen, not his head or chest, Moder said.

Owens agreed at his preliminary hearing that, if witnesses were called, the prosecution could show that a crime occurred and he might have been involved.

He allowed charges of aggravated assault, reckless endangerment and a firearms violation to proceed to Mercer County Common Pleas Court.

Owens was attending a birthday party at the former C. Browns Banquet Center, 300 Roemer Blvd., when the shooting occurred, police said.

Mosley was in the bar area and took a compact disc of the rap group DMX to the dance floor side of the establishment to have it played, police said.

Consuelo Owens, Owens' sister, threw the CD on the floor, and Mosley confronted her, police said.

Owens pulled out the gun and fired a single shot, police said, adding Owens was let out a side door after the shooting.

Mosley spent a day in the hospital of Sharon Regional Health System.

Owens is serving a sentence in Ohio for unrelated Trumbull County charges and is being lent to Mercer County while his case is processed here, Moder said.
