2 assault charges withdrawn
in fire scene arrest case

Charges of aggravated and simple assault were withdrawn from the case against Peter J. Fuchs, 42, of 36 E. Paul St., Shenango Township, according to the office of District Justice Henry J. Russo, Hermitage.

Charges of resisting arrest, failure to disperse, disorderly conduct and harassment were held for court by Russo at a preliminary hearing Wednesday.

The Herald was incorrectly told Wednesday that all charges had been held for court.

Fuchs was released on his own recognizance.

Fuchs was at a fire scene Nov. 15 at 20 Hnida Road, the mobile home of his brother, Michael, Shenango Township, police said.

When police called Michael Fuchs over to identify a gun cabinet that was taken from the burning mobile home, Peter Fuchs and other family members came over and had to be told several times to step back, police said.

Peter Fuchs yelled and argued with patrolman Jason Newton, used obscene language and jammed a finger in Newton's face and chin, police said.

Firefighters had to stop fighting the fire to help keep family members away from Newton and Peter Fuchs, police said.

Peter Fuchs called for someone to help him and was Maced by Newton, police said.
